The Review of the Engagement of Key Populations in the Funding Model global report is a research amongst key populations in eleven countries. It is a publication of the Communities Delegation of the Board of the Global Fund. It identifies six areas of concern regarding the Funding Model of The Global Fund and gives recommendations on how to improve community engagement. The global report is accompanied by a 3-page position paper summarising its conclusions. The areas of concern are: communication and transparency, representation and accountability, influence, safety and confidentiality, resources and strengthening of systems and capacities, culture, respect and authenticity. On April 22nd 2013, the U.S. Supreme Court will listen to evidence surrounding the case named USAID v AOSI (Alliance for Open Society International). The case relates to the constitutional status of the anti-prostitution pledge that must be signed by all USAID funding recipients. This pledge is a provision within the United States Leadership Against HIV/AIDS, Tuberculosis and Malaria Act of 2003 (known as the Leadership Act), which forces sub-grantees to explicitly oppose prostitution in order to qualify for U.S. Government funding to fight HIV and AIDS. The results of this case will have dramatic consequences for NGOs, faith-based groups, civil society, and importantly for NSWP’s members, for sex workers globally.

PEPFAR has made anti-retroviral treatment (ART) available for many people, including sex workers.  However, PEPFAR funding contracts with organisations specify that a certain amount of this money be spent on abstinence programming.  Contracts include a clause that the organisation accepting funding is opposed to prostitution.  This has been called the 'anti-prostitution pledge' or 'anti-prostitution loyalty oath'.
